Politicians in Texas Unable to Reconcile with SCOTUS Ruling

You would think that nearly one month into the nationwide legalization of same-sex marriage, politicians would be coming to terms with the reality of this decision. It appears that this is harder for some than others, and there is no better illustration of this than Texas.

Up until the Supreme Court ruling on June 26, same-sex marriage was illegal in Texas. Perhaps this is one of the reasons that politicians in the Lone Star State just can't seem to get on board. The reactions of numerous prominent political figures has been drastic and, in many cases, shocking. The controversy that same-sex couples are currently facing in Texas seems to be spearheaded by those at the top.

Ken Paxton, the Texas Attorney General, sent out a letter shortly after the ruling permitting state officials to defy the Supreme Court's decision if they so desired. His letter encouraged the right to freely exercise religion and speech, even saying that it was acceptable not to issue marriage licenses to same-sex couples.

In a similar vein, Senator Ted Cruz publicly shared his opinion on NPR that ignoring the Supreme Court was entirely acceptable. Cruz noted that the Supreme Court decision was only binding for the individuals directly involved in the case. He went on to say that in the future, he believes Supreme Court justices should be subject to elections.

These politicians' responses are mirrored in the behavior of county clerks across Texas. Many refused to issue same-sex marriage licenses and some even encouraged their staff to do the same. Others chose to quit their jobs altogether, rather than submitting to the Supreme Court.

What about the Rights of Same-Sex Couples?

There is no doubt that same-sex couples in Texas are facing extreme backlash, despite the nationwide ruling. This can make it difficult for these individuals to exercise their constitutional rights and pursue marriage, or even divorce as the case may be.
