What Is the Standard Possession Order in Texas?

When Texas courts decide on child custody (conservatorship), they must also set a visitation schedule, legally known as a Possession and Access Order. The most commonly used schedule is the Standard Possession Order (SPO).

What Does the Standard Possession Order Include?

The SPO outlines when each parent has physical possession of the child. It’s presumed to be in the child’s best interest for children age 3 and older.

Under the standard SPO, the non-custodial parent (the one who doesn’t choose the child’s primary residence) typically receives:

  • 1st, 3rd, and 5th weekends of each month
  • Thursday overnights during the school year
  • Extended time during summer (typically 30 days)
  • Alternating Thanksgiving, Christmas, and select holidays

Geographic Distance Matters

If the parents live within 100 miles of each other, the SPO may include more frequent visits, including midweek and extended summer periods.

If they live more than 100 miles apart, the schedule changes, usually offering fewer visits during the school year but longer periods in the summer and holidays.

Can Parents Agree on a Different Schedule?

Yes! Courts strongly encourage parents to agree on their own parenting plan—one that meets their child’s unique needs. As long as both parents agree and the plan is in the child’s best interest, the court is likely to approve it.

If no agreement is reached, the SPO will likely be the default.

Modifying the SPO

You can request a change to your possession schedule if there’s been a material and substantial change in circumstances, such as:

  • A parent moving
  • A change in the child’s school or needs
  • Conflict or safety concerns
