How to File a Protective Order in Texas
If you are in immediate danger:
- Call 911 and get to a safe place with your children.
- Law enforcement may remove the abuser from the home or make an arrest, providing you time to act.
You may file for a Temporary Protective Order (TPO), which provides immediate but short-term protection. Our attorneys will help you:
- Complete and file the required legal documents.
- Present your case to a judge at an ex parte hearing (the accused does not attend).
- Have the order served to the respondent by law enforcement or a process server.
The TPO is valid for approximately 14 days, during which a hearing is scheduled for a final protective order.
Final Protective Orders: Longer-Term Protection
At the final hearing, both sides can present evidence. Having a skilled attorney by your side is crucial.
A final protective order can:
- Ban all forms of contact between the abuser and the victim/children.
- Enforce a mandatory distance from your home, school, or workplace.
- Grant temporary custody of children.
- Order child or spousal support.
- Require the abuser to vacate the home or attend counseling.
- Prohibit firearm possession.
These orders typically last up to two years, and in severe cases, longer.
What If a Protective Order Is Violated?
If the respondent contacts you in any form or violates the order:
- Call 911 immediately.
- Report the violation to both the police and your attorney.
- Keep a copy of the order with you at all times.
Violation of a protective order is a criminal offense in Texas and should be taken seriously by law enforcement and the courts.
Do I Need an Attorney to File a Protective Order or Restraining Order?
You can file without legal representation—but it’s not recommended. Protective order cases often involve urgent timelines, high emotional stress, and serious legal consequences.
